NAKS collection of members’ data

The North American Kant Society (NAKS) provides this privacy policy to inform you of our privacy practices and the choices you can make about the way your information is collected online and how that information is used. We are committed to protecting the privacy of our members and others who visit our websites. This privacy policy covers the webpages belonging to NAKS in the United States only, and does not cover the privacy policies of any NAKS affiliates, foreign or domestic. Our site may also be referenced or accessible through links contained on other sites, including sites of third party e-procurement networks. However, we have not investigated and are not responsible for the privacy practices or content of those sites. Their policies and protections may be different than those offered by NAKS. We encourage you to investigate and review the privacy practices of those sites prior to use. This privacy policy and the policies described below may be updated and are subject to change from time to time. We encourage you to review this privacy policy periodically to confirm our current site policies. This statement discloses our information gathering and dissemination practices and explains how we use and protect personally identifiable information that we receive from our site.

Types of information collected

Personal information

NAKS uses personal information to better understand your needs and interests and to provide you with better service. On some NAKS websites, you can order products or services, request information, or subscribe to marketing or support materials. The types of personal information you provide to us on these pages may include name, address, phone number, email address, user IDs and passwords, billing and transaction information, credit card information, contact preferences, educational and employment background, demographic data, and job interest data. To personalize our websites, services, or communications, improve our products and services, and analyze the composition of our audience, we may also ask you to provide us with information regarding your personal or professional interests, demographics, and experiences with our products or services. Providing this additional information is optional.

Information needed to make a purchase

When you make a purchase, we will ask for your name, company or department name, address, phone number, email address, and other information necessary to fulfill and track your order. For purposes of billing, you may need to provide your NAKS membership information and credit card information, including type, number, expiration date, and billing address for the card. If your order is to be shipped, we also need the name, address and phone number of the intended recipient(s).

Non-personal information (including cookies)

When you visit our site, we may collect anonymous system information about your computer, such as your IP address. In certain areas of the site designated for specific members, we require personal contact information (such as your name and email address) in order to provide account access and perform commerce-related and other online service activities. This information is usually requested in the registration and order forms set forth in those areas. If you obtain access to one of those designated areas and you are required to sign in, we may use a "cookie" to identify your session on our website. Cookies are small files that are placed on your hard drive by a website. They act as unique identifiers for your computer, but cannot be used to identify any individual, only machines. We may use cookies to better understand the browsing or usage patterns of site visitors, as well as to enhance their experience at our site. Some website functionality may be limited if cookies are turned off in your browser.

Non-personal data we collect may include the pages visited, unique URLs visited within our web properties, browser type and IP address. Most non-personal data is collected via cookies or other analysis technologies.

How do we protect the security of your information?

If you enter credit card payment information (for example, MasterCard or Visa information) to purchase NAKS services or products, that information is encrypted and protected with industry standard encryption software. NAKS currently uses Secure Sockets Layer technology (SSL) to protect such information and ensure that credit card transactions are secure.

We protect our databases with various physical, technical and procedural measures and we restrict access to your information by unauthorized persons. Our information systems are maintained behind a software firewall to isolate them from access by other networks connected to the Internet. We use SSL technology, which is the electronic commerce standard for securing information as it travels over the Internet. SSL technology is designed to encrypt your information, preventing an unauthorized party from viewing and downloading your information. Your web browser should display a web address with an "https" prefix, indicating that the SSL technology is operating when using certain portions of our website.

Is information shared with third parties?

Any information we collect about you or your computer is used exclusively by NAKS to enhance and improve your visits to our site, or to provide you with requested information, products, or services. For example, when a member submits credit card information to NAKS in order to place an online order, such personal information is used only for payment and shipping purposes.

NAKS provides member names and mailing addresses and/or email addresses to third parties for one-time use as part of our mailing list rental program, which provides supplemental income to the association. NAKS reviews the material that will be sent in this one-time usage to prevent solicitations unrelated to the field of philosophy. NAKS monitors usage of rented mailing lists and strictly enforces the one-time use restriction. To be excluded from the mailing lists NAKS rents to third parties, update your contact preferences. Though your contact information will be promptly removed from the rental mailing lists upon receipt of your request, please allow up to three months for third-party communications to completely cease, as communications using lists rented prior to receipt of your removal request may still be pending.

NAKS works with third-party vendors to provide essential member services, such as accepting and reviewing papers submitted to NAKS divisions for presentation at divisional meetings. These vendors process your data for the sole purpose of performing the tasks for which they are contracted. Your data is kept secure, and is never used by these vendors for marketing purposes, or for any purpose other than the contracted tasks.

We may also provide your information to reputable organizations that help us to fulfill an online order you initiate. For example, like all organizations that offer online purchases, NAKS uses companies to verify and process credit card transactions, to deliver packages, and to administer service programs. We may share information with others who help us analyze sales and demographic data, maintain our records, and provide other services for NAKS. We may also share your information with companies that act on our behalf and at our direction to notify you of additional NAKS products and services. These companies may also conduct member satisfaction surveys and manage other member services and benefits for us. These third parties are not authorized to use your information for any reason other than to perform their contractually assigned functions. We may share anonymized data with affiliates, partners, contractors, or other reputable parties in order to help us analyze information about the association and the profession, assess usage trends, improve site layout or design, or to maintain or upgrade our software and web capabilities.

If NAKS or substantially all of its assets are targeted for acquisition, member information may be disclosed on a confidential basis as part of the due diligence or investigative efforts of the potential third party acquirer. In the event of any actual acquisition, such information would be transferred as part of the transaction to the acquirer.

Opting in (EEA/EU members)

To opt in or opt out of communications, please log into NAKS website and use the Communication Preferences form to choose which communications you receive.

Opting out (unsubscribing)

To opt out of receiving communications you have requested (such as email newsletters, promotions, and product updates), use any of the following methods:

Select the email "opt-out" or "unsubscribe" link located at the bottom of any NAKS email or follow the opt-out instructions included in each subscription communication.

Update your communication preferences on NAKS website.

Write to the North American Kant Society. Be sure to provide your name, email address, postal address, and relevant information about your subscriptions and registrations.

Additional uses of collected information

NAKS member directory

NAKS member directory is provided as a service to NAKS membership. NAKS prohibits the use of this site by a third party to obtain email addresses of NAKS members for the purpose of mass mailings (commonly called "spamming") or any type of marketing, regardless of the sender's intent. NAKS will request that any offending email accounts be terminated by the user's Internet Service Provider or Academic Institution.

Anyone receiving a blanket message they believe to have been sent using these lists should report it to NAKS national office at northamericankantsociety@gmail.com. Please save the offending message so that the sender may be authenticated.

NAKS membership list

NAKS membership list published on NAKS website or made available to members by any other means is published for the exclusive use of members of the North American Kant Society for purposes of reference and personal correspondence. It is not to be used for any commercial purpose. Producing or using mailing labels or computerized mailing lists generated from this published list is a violation of United States and international copyright laws.

Research and analysis

Anonymized data about NAKS members and website users, such as demographic information and professional and educational background, may be shared with third parties for the purposes of research and analysis (e.g., to study the demographic composition of NAKS membership). Names, contact information, and similar individually identifiable information will not be provided to third parties for research and analysis purposes.

Online payment receipts

The information transmitted in payment receipts is intended only for the person or entity to which it is addressed and may contain confidential and/or privileged material. Any review, retransmission, dissemination or other use of, or taking of any action in reliance upon this information by persons or entities other than the intended recipient, is prohibited. If you receive a receipt in error, please contact the sender and delete the offending material.

Children's online privacy

NAKS is committed to the preservation of online privacy for all of its visitors, including children. We do not knowingly collect information about children or sell products to children. In accordance with the Children’s Online Privacy Protection Act, we will not knowingly collect any information from children under the age of 13. If you are under the age of 13, you must ask your parent or guardian to assist you in using any and all NAKS web properties.

GDPR

Scope. This section applies if you are an individual located in the European Union (“EU”) (“EU Data Subject”). For these purposes, reference to the EU also includes the European Economic Area countries of Iceland, Liechtenstein and Norway and, where applicable, Switzerland.

Data Controller. The North American Kant Society is the data controller for the processing of your Personal Data, but we act as data processor on behalf of Clients for Personal Data that we process through our websites.

Your Rights. Subject to applicable law, you have the following rights in relation to your Personal Data:

Right of access: If you ask us, we will confirm whether we are processing your Personal Data and, if so, provide you with a copy of that Personal Data (along with certain other details). If you require additional copies, we may need to charge a reasonable fee.

Right to rectification: If your Personal Data is inaccurate or incomplete, you are entitled to have it rectified or completed. If we have shared your Personal Data with others, we will tell them about the rectification where possible. If you ask us, where possible and lawful to do so, we will also tell you with whom we shared your Personal Data so that you can contact them directly.

Right to erasure: You may ask us to delete or remove your Personal Data and we will do so in some circumstances, such as where we no longer need it (we may not delete your data when other interests outweigh your right to deletion). If we have shared your data with others, we will tell them about the erasure where possible. If you ask us, where possible and lawful to do so, we will also tell you with whom we shared your Personal Data so that you can contact them directly.

Right to restrict processing: You may ask us to restrict or ‘block’ the processing of your Personal Data in certain circumstances, such as where you contest the accuracy of that Personal Data or object to us processing it. We will tell you before we lift any restriction on processing. If we have shared your Personal Data with others, we will tell them about the restriction where possible. If you ask us, where possible and lawful to do so, we will also tell you with whom we shared your Personal Data so that you can contact them directly.

Right to data portability: Effective 25 May 2018, you have the right to obtain your Personal Data from us that you consented to give us or that is necessary to perform a contract with you. We will give you your Personal Data in a structured, commonly used and machine-readable format. You may reuse it elsewhere.

Right to object: You may ask us at any time to stop processing your Personal Data, and we will do so:

If we are relying on a legitimate interest to process your Personal Data — unless we demonstrate compelling legitimate grounds for the processing; or

If we are processing your Personal Data for direct marketing.

Rights in relation to automated decision-making and profiling: You have the right to be free from decisions based solely on automated processing of your Personal Data, including profiling, that affect you, unless such processing is necessary for entering into, or the performance of, a contract between you and us or you provide your explicit consent to such processing.

Right to withdraw consent: If we rely on your consent to process your Personal Data, you have the right to withdraw that consent at any time. This will not affect the lawfulness of processing based on your prior consent.

Right to lodge a complaint with the data protection authority: If you have a concern about our privacy practices, including the way we have handled your Personal Data, you can report it to the data protection authority that is authorized to hear those concerns. You may exercise your rights by contacting us through the GDPR Action Form.

Legitimate Interest. “Legitimate interests” means the interests of NAKS in conducting and managing our organization. For example, we have a legitimate interest in processing your Personal Data to analyze how the Websites, Apps and our products and services are being used by you, and to ensure network and information security, as described in this Privacy Policy. When we process your Personal Data for our legitimate interests, we make sure to consider and balance any potential impact on you, and your rights under data protection laws. Our legitimate interests do not automatically override your interests. We will not use your Personal Data for activities where our interests are overridden by the impact on you, unless we have your consent or those activities are otherwise required or permitted to by law.
